By accessing or using labTRACK, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
labTRACK is a software-as-a-service lab inventory management tool operated by Gil Otis ("we", "us", "our"). The service is provided strictly as an organizational and reference tool. We make no guarantees regarding uptime, availability, accuracy, or fitness for any particular purpose. The service is provided "as is" and "as available" without warranty of any kind, express or implied.
You must be at least 18 years old and authorized to enter into a binding agreement on behalf of your organization to use labTRACK. By using the service, you represent that you meet these requirements.
New labs receive a 2-month free trial period. After the trial period expires, continued access to the service requires a paid subscription at the then-current rate ($10/month per lab at the time of writing). We reserve the right to modify pricing with 30 days' notice. Failure to subscribe after the trial period may result in suspension of access to your account and data.

You retain full ownership of all data you input into labTRACK. You grant us a limited, non-exclusive license to store and process your data solely for the purpose of providing the service. We do not sell your data or use it for advertising. Upon account termination, your data may be deleted after a reasonable retention period. You are solely responsible for maintaining backups of any critical data. See our Privacy Policy for full details.
labTRACK provides permit thresholds, hazard classifications, and compliance information strictly as a reference tool based on publicly available data. This information may be incomplete, outdated, or inapplicable to your specific jurisdiction or situation.
You are solely and exclusively responsible for ensuring your lab's full compliance with all applicable laws, regulations, and permit requirements. labTRACK does not constitute legal, regulatory, or safety advice. You must independently verify all regulatory limits and requirements with the relevant authorities before relying on them. We expressly disclaim any responsibility for regulatory violations, fines, penalties, or safety incidents arising from your use of or reliance on the service.
To the maximum extent permitted by applicable law, labTRACK and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue or profits, regulatory fines or penalties, safety incidents, personal injury, property damage, or business interruption, arising out of or in connection with your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claims arising under these terms shall not exceed the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or $50, whichever is greater.
You agree to indemnify, defend, and hold harmless labTRACK and its operators from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service; (b) your violation of these terms; (c) your violation of any applicable law or regulation; (d) any data you submit to the service; or (e) any regulatory non-compliance in your lab.
The service is not a substitute for professional regulatory, legal, chemical safety, or hazardous materials management advice. We do not warrant that the service will meet your specific requirements, be uninterrupted, timely, secure, or error-free. Any reliance you place on information provided by the service is strictly at your own risk.
We reserve the right to suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately. Provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts located in Israel.
We reserve the right to modify these terms at any time. We will notify users of material changes by email or by posting a notice within the service. Your continued use of the service after changes take effect constitutes your acceptance of the revised terms.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and labTRACK regarding the use of the service and supersede any prior agreements.
